For purposes of this Privacy Policy, "Melbi Wellness," "Melbi," "we," "our," and "us" refer to Melbi Wellness and its affiliates, as applicable. "You" and "your" refer to the individual using the Services. Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have read and understand this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.
This Privacy Policy is intended to explain our privacy practices. It does not replace any Notice of Privacy Practices provided by an independent healthcare provider, medical group, pharmacy, laboratory, or other HIPAA-covered entity that may provide services to you.

Important notice regarding healthcare services
Melbi Wellness provides access to wellness-related services, educational information, technology tools, customer support, care coordination, and, where applicable, access to independent licensed healthcare providers, pharmacies, laboratories, payment processors, fulfillment vendors, and other service providers. Melbi Wellness does not itself practice medicine, prescribe medication, dispense medication, or make clinical treatment decisions unless expressly stated otherwise.
Any medical care, clinical evaluation, diagnosis, prescription decision, treatment recommendation, or pharmacy service is provided by the applicable licensed healthcare provider, medical group, pharmacy, laboratory, or other licensed professional or entity, as applicable. Independent healthcare providers, medical groups, pharmacies, and laboratories may have their own privacy policies, notices of privacy practices, consent forms, terms, professional obligations, and legal requirements.
Information we collect
We collect information from and about you in several ways, including information you provide directly to us, information collected automatically through your use of the Services, information collected from social media or other content platforms, and information received from third parties.

C. Payment information
If you make a purchase or payment through the Services, your payment information may be collected and processed by our payment processors on our behalf. Payment information may include your billing name, billing address, card type, partial card number, expiration date, transaction amount, transaction date, and related payment details. We do not intend to store your full credit card number or full payment card verification code unless expressly stated otherwise.

When you use the Services, we and our service providers may automatically collect information about your device, browser, and interaction with the Services, including:

We do not use geofencing around healthcare facilities to identify, track, collect information from, or target individuals based on their attempt to receive health-related services.

We and our service providers may use cookies, pixels, web beacons, tags, SDKs, scripts, local storage, log files, and similar technologies to collect information about your use of the Services. These technologies may help us:

How we use your information

Health information, PHI, and HIPAA
Some health-related information may be considered "protected health information" or "PHI" under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations, as amended from time to time, when it is created, received, maintained, or transmitted by or on behalf of a HIPAA-covered healthcare provider, health plan, healthcare clearinghouse, or their business associate.
Where HIPAA applies, the use and disclosure of PHI may also be governed by the applicable healthcare provider's, medical group's, pharmacy's, or other covered entity's Notice of Privacy Practices. This Privacy Policy does not replace any Notice of Privacy Practices provided by a healthcare provider, medical group, pharmacy, or other HIPAA-covered entity.
Where Melbi Wellness receives or processes PHI as a business associate or subcontractor business associate, Melbi Wellness will use and disclose such PHI only as permitted by applicable law and any applicable business associate agreement or similar written agreement. Where Melbi Wellness receives health-related information that is not subject to HIPAA, we will handle that information in accordance with this Privacy Policy and applicable federal and state privacy laws.
Consumer health data
Certain state laws may provide additional protections for "consumer health data," "personal health data," or similar categories of health-related information that may not be subject to HIPAA. Depending on where you reside and how you use the Services, consumer health data may include information that identifies or is reasonably capable of being associated with you and relates to your past, present, or future physical or mental health status, wellness goals, symptoms, diagnoses, conditions, treatments, medications, prescriptions, lab results, biometric information, reproductive or sexual health information, gender-affirming care information, or precise location information that could reasonably indicate an attempt to receive health-related services.

E. No sale of consumer health data
We do not sell consumer health data for monetary consideration. We do not knowingly share consumer health data for targeted advertising, retargeting, lookalike audience creation, or cross-context behavioral advertising. We do not knowingly disclose protected health information, medical intake responses, prescription requests, provider communications, lab results, patient portal messages, or pharmacy fulfillment communications to advertising platforms for targeted advertising.
F. Consumer health data rights
Depending on your state of residence, you may have the right to request access to, correction of, deletion of, or withdrawal of consent for certain consumer health data, subject to applicable legal exceptions. We may deny or limit a request where permitted by law.
Online analytics and advertising
A. Analytics
We may use analytics tools and service providers to collect and analyze information about use of the Services. These tools may help us understand website traffic, user behavior, performance, errors, conversion activity, and marketing effectiveness.
B. Advertising
We may use advertising technologies on general informational pages of our websites to help deliver, measure, and improve advertising for Melbi Wellness products and services. C. Health data restrictions on advertising tools
We do not intend for advertising pixels, retargeting tools, or similar tracking technologies to collect or transmit protected health information, patient portal communications, medical intake responses, prescription information, lab results, provider messages, or pharmacy fulfillment information. We do not knowingly use information you provide in medical intake forms, prescription requests, provider communications, lab results, patient portal messages, or pharmacy fulfillment communications for targeted advertising or cross-context behavioral advertising.
D. Email analytics
If you receive email from us, we may use analytics tools such as pixels or similar technologies to understand whether emails are opened, links are clicked, or communications are effective. You may be able to block some of these technologies through your email settings.
E. Your advertising choices
You may be able to manage cookies and advertising preferences through your browser settings, device settings, or third-party opt-out tools. If you opt out of interest-based advertising, you may still see advertising, but it may be less tailored to your interests.
Do Not Track and opt-out preference signals
Some browsers offer "Do Not Track" signals. There is currently no uniform industry standard for how websites should respond to Do Not Track signals, and we may not respond to all Do Not Track signals. Where required by applicable law, we will honor legally recognized opt-out preference signals, such as Global Privacy Control, in accordance with applicable requirements and our ability to recognize such signals.

We may share your information with independent healthcare providers, medical groups, pharmacies, laboratories, and related healthcare or pharmacy service providers to facilitate requested services, including intake review, consultation, care coordination, prescription decisions, pharmacy fulfillment, lab testing, treatment support, and related healthcare operations.

If you separately opt in to receive marketing communications, we may send you promotional emails, calls, or text messages. Consent to receive marketing text messages is not a condition of purchase. Message and data rates may apply. Message frequency may vary. You may opt out of marketing emails by following the unsubscribe instructions included in the email. You may opt out of marketing text messages by replying STOP. You may request help by replying HELP.

D. Shine the Light
California's "Shine the Light" law allows California residents to request certain information about disclosures of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes unless required consent has been obtained or the disclosure is otherwise permitted by law.
Privacy information for Nevada residents
Nevada residents may have the right to opt out of the sale of certain covered information for monetary consideration to a person for that person to license or sell the information to additional persons. We do not currently sell covered information as defined by Nevada law. Nevada residents may submit a request regarding future sales by contacting us at info@melbiwellness.com.
Children and minors
The Services are intended for individuals who are at least 18 years of age. We do not knowingly collect personal information from children under 13 years of age. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete that information unless retention is required or permitted by law.
