Terms of Use

These Terms of Use ('Terms') govern your access to and use of melbiwellness.com (the 'Site'). By using the Site or joining the VIP waitlist, you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old and a resident of the United States to use this Site. By using the Site you represent and warrant that you meet these requirements.

Informational purpose only

The Site is for general informational and pre-launch marketing purposes. It is not medical advice and does not create a clinician-patient relationship. A clinician-patient relationship will only be established, if at all, after Melbi launches and after a licensed clinician reviews your intake and accepts you as a patient.

No emergency services

Melbi does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department immediately.

Forward-looking statements

Statements on this Site about future services, pricing, treatment availability, programs, or expansion are forward-looking and based on current expectations. They are subject to change without notice and depend on regulatory approvals, pharmacy availability, clinical appropriateness, and applicable law. Joining the VIP waitlist does not guarantee that any future service or treatment will be offered to you.

Future services

When clinical services launch, separate terms (including a Telehealth Consent, Consent to Treat, Notice of Privacy Practices, and program-specific subscription terms) will be presented at the time of intake. Continued participation will be subject to acceptance of those documents.

Subscription disclosure

Future Melbi programs are anticipated to be offered as auto-renewing subscription services. Specific subscription terms, billing intervals, refund policies, and cancellation procedures will be disclosed at checkout when services launch. You will be able to cancel any subscription at any time, subject to the terms disclosed at checkout.

Intellectual property

All content on the Site, including text, graphics, images, logos, product mockups, and software, is owned by Melbi or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any portion of the Site without our prior written consent, except for personal, non-commercial use.

Acceptable use

You agree not to (i) misuse the Site or attempt to disrupt its operation, (ii) submit false information through the waitlist form, (iii) scrape or copy content without permission, (iv) use the Site for any unlawful purpose, or (v) attempt to gain unauthorized access to any portion of the Site.

Third-party links and services

The Site may contain links to third-party websites and services. We do not control and are not responsible for the content, privacy practices, or actions of any third party.

Disclaimer of warranties

THE SITE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Limitation of liability

Indemnification

You agree to defend, indemnify, and hold harmless Melbi from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Florida, unless otherwise required by applicable law.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Site or by email. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

Statements have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.

Compounded medications. Compounded medications, if prescribed, are not FDA-approved. The FDA does not review compounded medications for safety, effectiveness, or quality before they are marketed. Compounded medications are prepared by a state-licensed compounding pharmacy specifically for the individual patient. Compounded medications are not the same as, are not equivalent to, and are not interchangeable with FDA-approved brand-name medications.

Clinician review required. Treatment is only available when clinically appropriate after an online health intake and review by a licensed healthcare provider. Approval is never guaranteed. Not all patients qualify. A provider may approve, deny, request more information, or require a brief live visit. Refills require continued clinical appropriateness review.

Pharmacy fulfillment. If prescribed, medication is dispensed by a state-licensed pharmacy and shipped directly to the patient. Melbi does not dispense or manufacture medication.

State availability. Melbi services will initially be available in Florida. Availability in additional states will be added over time, subject to applicable state law, licensure, and pharmacy availability.

Individual results. Individual results vary and are not guaranteed. Wellness outcomes depend on a wide range of factors. Product packaging shown on this site is for illustration only and actual product packaging may appear differently than shown.
